Abandoned tenant property removal is legal when you follow your state’s process: confirm the tenancy has ended, send the required notice, hold the belongings for the statutory period, and document everything before it moves. Rules differ by state, so check your statute and your attorney first. Once the notice period runs, Emergency Cleanings can clear the unit at one flat price with photos of every step.
The keys never came back. Rent stopped two months ago. You walk in and find a full closet and a fridge you would rather not open. Your owner wants the unit listed by the first. Your attorney wants you to slow down. This FAQ is for the property manager stuck between those two calls.
One note before the questions. Nothing here is legal advice. Abandoned property law is set state by state, and some cities add their own rules on top. Treat the statutes below as examples of how these laws are built, and run your actual unit past counsel.
When Does a Unit Count as Abandoned?
A missing tenant and an abandoned unit are two separate legal facts. A tenant on a long hospital stay still has a tenancy. So does one who moved in with family and plans to come back.
Most states give you a formal way to end the tenancy. California is a good example. Under Civil Code 1951.3, a landlord can send a notice of belief of abandonment only after rent has been due and unpaid for at least 14 consecutive days. The lease then ends on a date at least 15 days after personal service or 18 days after mailing, unless the tenant answers in writing that they do not intend to abandon.
An eviction judgment or a signed surrender can also end a tenancy. Which one you have changes what comes next.
How Long Do I Have to Hold What the Tenant Left?
Ending the lease does not end your duty to the belongings. Many states run a second notice for the property itself.
In California, Civil Code 1984 says the notice must give a reclaim date no less than 15 days after personal delivery or 18 days after mailing. If the tenant does not claim the items, Civil Code 1988 lets the landlord keep or dispose of property it reasonably believes is worth less than $700. Above that, the property goes to public sale.
Florida runs shorter clocks. Under Chapter 715 of the Florida Statutes, the claim date can be no fewer than 10 days after personal delivery or 15 days after mailing. The landlord must use reasonable care in storing the property. If the unclaimed items have a total resale value under $500, the landlord may keep them or dispose of them. Otherwise they go to public sale by competitive bidding.
Your state may look nothing like either one. Read your statute with counsel and put the reclaim date on your turn calendar the day the notice goes out.
What Should I Document Before Anything Moves?
Your photos are your defense if the former tenant calls six months from now about a missing laptop. Build the file before a single box leaves.
- Date-stamped photos and a slow video walk of every room, closet and cabinet
- A written inventory with a rough condition note for each item
- Copies of each notice, plus proof of delivery or mailing
- The name of everyone who entered the unit and when
- Meter readings and the condition of locks and windows
What Gets Stored and What Can Go?
Until the reclaim date passes, assume everything stays. After that, your statute and your attorney decide the line. A few categories need extra care no matter what the dollar value looks like.
- Personal papers, photos and ID documents
- Prescription medication
- Firearms, which may have their own handling rules in your state
- Vehicles, which usually fall under a separate process
- Anything that looks like it belongs to someone other than the tenant
Ask counsel about each of these before the clear-out day.
What About Spoiled Food, Needles or Waste?
A unit that sat for weeks can turn into a health problem. Rotting food draws pests into neighboring units fast. Ask your attorney whether your state allows you to remove perishables early, and photograph them before they go.
Sharps, animal waste, soiled bedding or bodily fluids change the job. That calls for a crew equipped for biohazard cleanup with the right protective gear. Our emergency cleanup service covers that kind of unit. Surface mold gets cleaned during the work. Water damage restoration and repairs belong to other trades.
How Does a Crew Clear the Unit With a Written Record?
Emergency Cleanings coordinates vetted local technicians, and for a property manager the process runs like this.
- You send photos or schedule a free on-site walkthrough.
- A technician scopes the unit and photographs it.
- A Project Coordinator calls with one flat price and the plan. That price is locked in writing before work starts.
- The crew separates anything you flagged to store, bags and hauls the rest, and photographs each room as it clears.
- You get before and after photos for the tenant file, and disposal records you can request.
Need a certificate of insurance for your vendor file? Ask when you book. Our technicians are insured. The junk removal services page lists what the crew hauls.
How Do I Keep the Turn on Schedule?
Count backward from the date the unit needs to list. Book the cleanup scope while the reclaim period is still running, so the price is set and the crew is on the calendar for the morning after the deadline. Line up paint, flooring and the make-ready cleaner behind it. Every day the unit sits full is a day of rent your owner does not collect.
Frequently Asked Questions
Can I change the locks on a unit I think is abandoned?
That depends on your state and on whether the tenancy has legally ended. Changing locks on a tenant who still has a tenancy can count as an illegal lockout in many places, so confirm with counsel first.
Can I charge the former tenant for storage and removal?
Many state statutes allow the landlord to recover reasonable storage costs before releasing property. Check your statute for what you can charge and how to collect it.
What if the tenant comes back after the items are gone?
Your notices, inventory and photos show what was there and what you did with it. Hand that file to your attorney right away.
Can Emergency Cleanings clear a unit the same week we call?
Often, yes. We offer same-day response, and a scope set from photos or a walkthrough lets the crew go in as soon as your reclaim date passes.
